Curtis Wade, conducted work under the business names IKON Homes and Black Label Development.
Mr. Wade was last known to work for Lennar Homes in the Natomas area of Sacramento. Complaint 342020-00280536 was filed in the Sacramento Superior Court against Mr. Wade for:
1) Breach of Contract, 2) Breach of Implied Covenant of Good Faith and Fair Dealing, 3) Breach of Fiduciary Duty, 4) Fraud - False Promise, 5) Intentional Misrepresentation, 6) Conversion, and 7) Elder Abuse.
The Sacramento Superior Court Complaint alleges:
"By the conduct described herein, WADE engaged in financial elder abuse because his treatment of Plaintiff resulted in physical harm and/or pain and/or mental suffering in violation of California Welfare & Institutions Code section 15610.07(a) and Plaintiff is entitled to the remedies provided by the Elder Abuse Act."
"The aforementioned conduct of WADE was malicious, oppressive, fraudulent, and an intentional misrepresentation depriving Plaintiff of property or legal rights or otherwise causing injury, and was despicable conduct that subjected Plaintiff to a cruel and unjust hardship in conscious disregard of Plaintiff’s rights, so as to justify an award of exemplary and punitive damages to prevent the recurrence of the same conduct in the future."
"In committing the actions and conduct described above, WADE acted with recklessness, oppression, fraud, and malice, and Plaintiff therefore is entitled to an award of exemplary or punitive damages under California Welfare & Institutions Code section 15657.5 and California Civil Code section 3294, and treble damages pursuant to California Civil Code section 3345."
